The issue is that this person wrote the software and then profited and advertised it specifically for malicious uses. That implies intent, and intent matters.

Except there is opposing intent of him disabling the software of people implying they use it for illegal purposes.
And there is an explanation that moves his advertisement there from intent to negligence.
