I think the confusion is that the old nodes might create new chains that the new nodes will not follow. But with >90% of the hash power of the network on one side, the old-style blocks will be orphaned pretty quickly. And all clients will follow the longest chain they consider legitimate, so old-style blocks will just be ignored after they are orphaned.
